Kenya Introduces Mandatory Certificate of Origin for All Imports (Effective July 2025)

2 min read

πŸ‡°πŸ‡ͺ New Import Requirement from KRA Effective July 2025

The Kenya Revenue Authority (KRA) has introduced a new directive that will affect all individuals and businesses involved in importing goods into Kenya. Starting 1st July 2025, every consignment must be accompanied by a valid Certificate of Origin (COO), in accordance with Section 44A of the Tax Procedures Act, CAP. 469B (amended by the Finance Act, 2025).

This update replaces previous guidelines where COOs were only required under preferential trade arrangements.

πŸ“„ What Is a Certificate of Origin?

A Certificate of Origin is an internationally recognized document that certifies the country where goods were manufactured or produced. It is issued by a competent authority, typically a government agency or a designated organization in the exporting country.

Many businesses are now searching online for how to get a Certificate of Origin in Kenya, especially with the new rules taking effect. It’s important to understand both the process and the requirements to remain compliant.

πŸ“‹ Certificate of Origin Requirements

To be accepted by KRA customs officials, the COO must clearly include:

  • βœ… Name and address of the exporter
  • βœ… Name and address of the importer
  • βœ… Port of origin
  • βœ… Accurate description of the goods
  • βœ… Quantity of the goods
  • βœ… Country of origin
  • βœ… Country of destination

Note: This is now mandatory for all imports, not just goods under trade agreements.

βš–οΈ Penalties for Noncompliance

Importers who do not comply with the new regulations face serious consequences:

  • ❌ Seizure or forfeiture of goods
  • ❌ Penalties under the Tax Procedures Act

The KRA has emphasized that failure to present a valid Certificate of Origin will be treated as a compliance offense.

⏳ Transitional Grace Period: Until 30th September 2025

To help businesses adjust, the KRA has provided a transitional window through 30th September 2025. During this period, importers are expected to:

  • πŸ”„ Coordinate early with suppliers to obtain required documentation
  • πŸ“¦ Ensure all consignments include a valid COO
  • ⚠️ Prepare for strict enforcement beginning 1st October 2025

πŸ’Ό Why This Regulatory Shift Matters

The requirement is part of broader efforts by the KRA to:

  • πŸ” Enhance supply chain transparency
  • πŸ›‘οΈ Prevent tax evasion and trade fraud
  • 🌍 Align with international trade standards
  • 🧾 Strengthen customs enforcement mechanisms

This move will not only streamline customs processes but also improve revenue accountability and compliance.

πŸ“£ What Importers Should Do Now

To remain compliant and avoid disruptions in your import operations, here’s what we recommend:

βœ… Audit your documentation workflows
βœ… Educate your supply partners on COO requirements
βœ… Train customs, procurement, and logistics staff
βœ… Consult professionals familiar with Kenyan trade laws
